Testimony was heard through witnesses concerning the complaint filed by Barry Tidwell naming Boo Haughton as the defendant. The complaint contested the election results naming fraud, corruption and misconduct on behalf of the election officials, votes not counted, and individuals who were told they could not vote. After the testimony of six witnesses and closing arguments Judge Bentley granted a Summary Judgement and declared Boo Haughton the official winner of the Haleyville School Board - Place #2. The two Haleyville School Board ballots found in the ARC General Election box were placed in the wrong box by the voters and are not considered legal ballots.
